Annex

1. After the entry into force of this Agreement, any member economy of the Asia Pacific Economic Cooperation forum ("APEC member economy") as listed in the Appendix to this Annex may, by a written instrument delivered to the Depositary, agree to be bound by this Agreement if it meets the following criteria:
   1. it is unable to accede under the terms of Article 20 of the Agreement; and
   2. it agrees to be bound by the aviation security conventions listed in Article 7, paragraph 1 of this Agreement or such conventions otherwise apply to it.
2. Any APEC member economy which agrees to be bound by the Agreement as provided for in paragraph 1 shall, in its relations with all Parties (other than those with which the Agreement shall not apply pursuant to a notification of non-application of the Agreement under Article 20, paragraph 5), have all of the rights and obligations provided for Parties under this Agreement. A Party (other than those with which the Agreement shall not apply pursuant to a notification of non-application of the Agreement under Article 20, paragraph 5) shall, in its relations with such APEC member economy, have all of the rights and obligations provided for Parties under this Agreement. The rights and obligations described in this paragraph shall be effective on the 30th day after the expiry of the 90-day period referred to in paragraph 5 of Article 20.
